Motion to Dismiss Request for an Appeal Hearing

A three-member panel of the State Environmental Commission (SEC) will conduct a hearing on a Motion to Dismiss a request that was made on behalf of Tahoe Western Asphalt, LLC (TWA) for an appeal hearing. The hearing will take place on December 19, 2017 in Carson City, Nevada at the Legislative Building, Room 1214, located at 401 South Carson Street.

About the Hearing — On October 2, 2017, a request for an appeal hearing was submitted by Tahoe Western Asphalt, LLC (TWA). On October 11, 2017, the Nevada Division of Environmental Protection (NDEP) submitted an amended Petition for Leave to Intervene and a Motion to Dismiss the request for an appeal hearing filed by TWA. On October 23, 2017, the State Environmental Commission (SEC) granted NDEP’s Petition for Leave to Intervene. The SEC has therefore scheduled a hearing regarding the NDEP Motion to Dismiss Appeal. The hearing will be held on December 5, 2017, beginning at 9:00 a.m. in Carson City, Nevada at the Legislative Building, Room 1214, located at 401 South Carson Street.

The SEC must determine if it has jurisdiction to hear this appeal pursuant to NRS 445B.340.
