SEC Meetings
Regulatory: The most recent meeting of the SEC was held on Wednesday February 13 th in Carson City at the Bryan Building. The next meeting is scheduled for Wednesday June 12, 2013.
Appeals: An SEC Appeal hearing for the Silver Peak Lithium Project has been tentatively scheduled for July 12, 2013. The appeal, which was filed by the Silver Peak Ad Hoc Advisory Committee (SPAHAC), pertains to a Water Pollution Control Permit issued by the Nevada Division of Environmental Protection to the Chemetall Foote Corporation. The company is now known as Rockwood Lithium Inc. The permit authorizes the construction, operation, and closure of an approved chemical process facility at the Silver Peak Lithium Project site in Silver Peak Nevada.
SEC Rules of Practice
Amended SEC Rules of Practice — On May 30, 2012 the Legislative Commission approved certain amendment to State Environmental Commission's (SEC) Rules of Practices. The amended rules update NAC 445B.875 to NAC 445B.895, which is the section in the Nevada Administrative Code (NAC) that governs the practices of the SEC in contested cases (i.e., appeal hearings). In general, the amended regulation clarifies the standard of review, defines procedures for briefs, addresses admission of evidence, and requires attorneys to be licensed in Nevada or associated with a Nevada licensed attorney in appeals before the SEC.
